Martz Wins Appeal *** Updated

Updated:  The firm of Freeland Shull, PLLC in Oxford, Mississippi is pleased to announce that the Mississippi Court of Appeals, on October 11, 2010, unanimously affirmed the Circuit Court's decision dismissing the Claimant's case.  In sum, Freeland Shull was successfully able to defend this case before the administrative judge, Mississippi Workers' Compensation Commission, Union County Circuit Court, and the Mississippi Court of Appeals, winning unanimous decisions at each level.  Read the entire opinion for yourself here.


The Claimant's appeal of case decided in favor of the Employer, discussed in an earlier news article, was denied in an order from the Union County Circuit Court dated July 28, 2010.  Oral arguments in the case were held on July 22nd in Oxford before the Hon. Andrew Howorth.  In affirming the decision of the Mississippi Worker's Compensation Commission, Judge Howorth rejected the Claimant's argument that the MWCC did not have a substantial basis for its ruling and/or that it acted arbitrarily or capriciously. 

The Claimant has appealed to the Supreme Court of Mississippi.
